What are Terms of Service (ToS)?

Every SaaS company needs comprehensive Terms of Service to protect themselves legally and set clear expectations with customers.

• Legal Protection: ToS limit a company's liability and protect against frivolous lawsuits. For example, a ToS can specify that the service is provided "as-is" without warranties, limiting liability for outages or data loss.
• User Responsibilities: ToS clarify user responsibilities and prohibit misuse (hacking, spam, illegal activity). This protects the service from abuse and protects other users.
• Intellectual Property: ToS clarify who owns the intellectual property created in the service. Does the user own their data? Can the company use user data for analytics or research?
